The Nikolaikirche is one of the oldest buildings in the city. It is mentioned for the first time as a Nikolaikapelle in the Akener Schöffenbuch in 1265. It can be assumed that it was founded by merchants and travelers who used the Aken Elbe crossing. In 1270 the St. Nicholas' Chapel was raised to the rank of collegiate church by the Augustinian canons. In the years 1317 - 1335 the collegiate church, which was destroyed by a devastating flood of the Elbe (1316), was restored.

A Holy Spirit Chapel stood on this site, probably belonging to a Holy Spirit Hospital. This was first mentioned in the Aken aldermen's books in 1265. In 1270, Duke John I of Saxony founded a St. Nicholas Church there and established a collegiate foundation.[1][2] The foundation was confirmed by Archbishop Conrad of Magdeburg and King Rudolf.

The foundation was granted several privileges and possessions: it had the sole right to teach in Aken, its own jurisdiction, and its own rights to collect customs and taxes. Furthermore, St. Mary's Church was placed under its control as a branch church.
